Terms of Service
1. Acceptance of Terms
By downloading, installing, or using Silly Smile Live Wallpaper (the "App"), you agree to these Terms of Service ("Terms") and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the App.
2. Eligibility
You must be at least 13 years old to use the App. If you are under the age of majority in your country, you may use the App only with the involvement of a parent or guardian. The App is not available where prohibited by law or to persons on applicable sanctions lists.
3. License Grant
EXO grants you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, for your personal, non-commercial use. You may not copy, modify, reverse engineer, distribute, sell, or create derivative works from the App, except as permitted by law.
4. Wallpapers & Content
Wallpapers, images, animations, logos, and other content in the App are owned by EXO or its licensors and are protected by intellectual property laws. They are provided for personal use as device wallpapers only. You may not redistribute, resell, or use them commercially without permission.
5. Advertising
The App is free and supported by third-party advertising. By using the App you agree to the display of ads as described in our Privacy Policy. Ads are provided by third parties and are not endorsed by EXO.
6. App Store EULA Addendum (iOS)
Because you obtained the App from the Apple App Store, the following additional terms apply:
- Acknowledgment. These Terms are between you and EXO only, not Apple. Apple is not responsible for the App or its content.
- Scope of License. The license is limited to a non-transferable license to use the App on Apple-branded devices you own or control, as permitted by the Apple Media Services Terms, including Family Sharing where applicable.
- Maintenance and Support. EXO, not Apple, is solely responsible for any maintenance and support.
- Warranty. EXO is solely responsible for any product warranties. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation.
- Product Claims. EXO, not Apple, is responsible for addressing any claims relating to the App, including product liability, failure to conform to legal/regulatory requirements, and consumer protection claims.
- Intellectual Property. EXO is responsible for handling any third-party claim that the App infringes intellectual property rights.
- Legal Compliance. You represent that you are not located in a US-embargoed country and are not on any US Government restricted-parties list.
- Developer Contact. EXO — thongintech@gmail.com.
- Third-Party Terms. You agree to comply with applicable third-party terms (for example, your wireless data plan) when using the App.
- Third-Party Beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
7. Acceptable Use
You agree not to misuse the App, including by: attempting to interfere with or disrupt the App or its servers; reverse engineering or scraping; bypassing or manipulating advertising; using automated means/bots; or using the App for any unlawful purpose.
8. Intellectual Property
All rights, title, and interest in the App (including software, design, and trademarks) remain with EXO and its licensors. No rights are granted except the limited license in Section 3. Any feedback you provide may be used by us without obligation to you.
9. Third-Party Services
The App integrates third-party services (Firebase, AdMob and mediation partners, Adjust). Your use of those services is also subject to their terms and privacy policies, as listed in our Privacy Policy. EXO is not responsible for third-party services or content.
10. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or secure. Where applicable consumer law prohibits such disclaimers, they apply only to the extent permitted.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE APP. Because the App is provided free of charge, our total aggregate liability will not exceed USD $10. Nothing limits liability that cannot be limited under applicable law.
12. Indemnification
You agree to indemnify and hold EXO harmless from claims arising out of your misuse of the App or your violation of these Terms or any law or third-party right.
13. Termination
You may stop using the App at any time by deleting it. We may suspend or terminate your access if you violate these Terms. Sections that by their nature should survive (intellectual property, disclaimers, limitation of liability, indemnification, governing law) survive termination.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be indicated by updating the "Last updated" date and, where appropriate, an in-app notice. Continued use after changes means you accept the updated Terms.
15. Governing Law & Disputes
These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to conflict-of-laws rules. Disputes will be resolved in the competent courts of Vietnam, except where mandatory consumer-protection law of your country of residence grants you the right to bring proceedings locally. EU/UK consumers may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
